in the country ranked on crime data compiled by the fbi. st. louis at the top with more than 2,000 crimes per 100,000 residents. the national average is about 430. the hunt is on in morning for a man who broke into a north berkeley home and raped a girl. sharon chin joins from us berkeley now, where investigators are learning more about the suspect's connection to the victim. sharon. reporter: good morning. yeah, police here in berkeley say that they put out a statewide alert for a sexual predator they say may have headed to mexico. here is his picture. police say 27-year-old omar sosa of berkeley is suspected of assaulting a girl in her bedroom after forcing her way into her evelyn street home through an unlocked window after 6 a.m. saturday. he is described as between 20 and 30, 6 feet tall, 190 pounds with a very pronounced nose and heavy accent. he may have injuries on his hand and fingers. now, officers say the attack was not random, the suspect knows the victim's family.

they say he is driving a gray 1997 ford ranger pickup with a double cab and white camper shell. the attack was not random, the police say the suspect is no stranger to the victim's family. >> wanted to get out in front and share the details of this suspect and the fact that we don't believe he is in the area. we want to reassure our berkeley residents that this predator is no longer in our city and we're diligently pursuing him. >> an officer describing the severity of the attack says not two minutes, it was a significant sexual assault. police say the victim provided information that the officers needed to put out an arrest warrant 18 hours later. berkeley police say if you know anything about this suspect, you are urged to call berkeley's special crime detail at (510)981-5734. >> all right. thank you very much, ariel

sharon in berkeley. this morning the head of the tsa is appearing to change his stand on the new patdowns. he is suggesting people not boycott. mark sayre reports. reporter: the tsa in damage control mode this morning after yesterday flatly saying there would be no changes at all to the patdowns that are very invasive. this morning a different tune from the director of the tsa. of course, passengers have been complaining about these new security procedures since they were implemented. yesterday the tsa director said on the sunday talk shows that there would be no change to these patdown policies. but then in a written statement late yesterday, and again this morning on the tv talk shows, tsa director john pistole now says federal officials do understand that there is a balance between safety and privacy. >> no, i'm opposed to that. i think the scanning is important somehow. some kind of security. >> do you think the protests may cause some delays? >> absolutely. absolutely. it's always the few that ruin it for the majority.

so... >> reporter: now, the tsa is reaffirming its commitment to review its policies on patdowns. it says they must be, quoting now, as minimally invasive as possible. tsa director john pistole saying only one percent of passengers going through the full-body scanners are opted out and refusing to pass through them, at which point they are subjected to these new patdowns that are the source of such controversy. in terms of what changes and when, those are questions we don't have answers to just a couple of days before what's usually the busiest travel day of the year, the wednesday before thanksgiving. >> no kidding. mark sayre in san jose, thank you. tobacco retailers plan to rally this afternoon against two proposed license fees in silicon valley. tomorrow santa clara county supervisors will consider a $425 annual fee for businesses to sell tobacco products. san jose is already moving forward with a $450 annual fee. city council members could vote on that as early as next month.

today's forecast. a cloudy start with showers still expected. temperatures in the morning from the lower 40s to the lower 50s. for this afternoon, still a chance of showers and cold temperatures. today's highs in the lower to the mid to the upper 50s. bear in mind winds up to 15 miles per hour. so that's going to help that air temperature feel a lot cooler than it is. so what's causing all this? big low pressure system digging in. and that's the cause of the showers, that's why it's going to be cold and that's why it's going to be windy. the closer that low pressure system gets to the bay area, the higher the likelihood of picking up rainfall. so late tonight, the chance of showers will increase as well as throughout the day for tomorrow. so here's a look at our five- day forecast. showers expected today, rainfall likely for tomorrow. wednesday, thursday, friday, plenty of sunshine. a really nice holiday forecast except it will be a little chilly. lower to the upper 50s. and rainfall will be back in the forecast saturday and sunday. that's your weather this morning. here's your traffic with

13-year-old girl. police believe he and the family knew each other and they think sosa is headed to mexico. the busiest day for air travel could get more complicated because of a planned protest. there is a call for passengers to reject the full-body scans at some airports on wednesday and insist on a patdown instead. the head of the tsa urges against that and says screening procedures could be tweaked to be less invasive. san francisco supervisors are considering a new charge at the grocery store, a 10-cent fee for a bag, paper or plastic, even if it' recyclable to encourage people to bring their own bags. >> so just in time for christmas, are you looking for an unusual pet? well -- >> no! >> yes, you are. come on. your children would love one of these. plenty of furry critters in san jose will be ready for adoption soon. animal rescuers think they have about 1,000 rats in their care. they were rescued from a rat hoarder in l.a. and relocated to the warehouse space of a pet store in san

commute coming up. 6:24. if you're driving somewhere for thanksgiving dinner it's going to cost you more. the price of gas has shot up 5 cents in the past two weeks. 27 cents since september 1. and that could mean that people have less money to spend on their holiday shopping which is a big negative for the economy. >> nothing affects the consumer psyche more than the ups and downs in gas prices. you drive down the street and that price is in your face. that adds a big hit to the shoppers' psyche. >> gas prices usually drop this time year but oil prices run because of a declining dollar. here in california, the average price of gas is $3.13 a gallon. the lundberg survey also says that san francisco drivers pay the most, 3.20 a gallon. and if you want the cheapest gas in the state, you will have to drive down to fresno at 3.09. dinner or turkey day will cost you more this year. the food institute says turkey prices now average $1.05 a

overcrossing. elsewhere this made bridge is find towards the toll plaza and still looks greats across the span in either direction. back to you. >> thank you. a hearing is set this morning on efforts to block california from selling state buildings. the state hopes to raise more than $1 billion by selling two dozen buildings. the suit contents the sales are unconstitutional because they include court buildings and the state judicial council has not given it approval. the plaintiffs are two former members of the state building board. we have a warning for people in san jose this morning. police are investigating a scam with a money wire transfer business. they say this company operated under the name of the three men.com. it would keep the victims' money instead of transferring the funds. police are checking to see if that same company also scammed people with prepaid phone cards. in just about two hours, a prison inmate at san quentin will give his plea in the

murder of another inmate. frank anthony sousa is accused of killing a 44-year-old man back in july. the victim had been convicted of killing a young girl while drunk driving. time now 6:38. iran has set a february trial date for the three american hikers accused of spying. sarah shourd, shane bauer and josh fattal were arrested more than a year ago along the iraq iran burpedder. -- border. sarah shourd was returned to the u.s. iranian officials delayed the trial because shourd hadn't been summoned to appear in court. bauer and fattal are still in prison. all three deny all charges. some say the internet is killing off traditional newspapers but this morning, there is talk of a new newspaper for the ipad. matt bigler explains it all from kcbs radio's silicon valley bureau. matt, good morning. >> reporter: good morning, sydnie. yeah, this new newspaper wouldn't be on paper at all.

it would be on the ipad. it's coming from news corporation, which already publishes several publication like the "wall street journal" and some newspapers in europe. but this would be called the daily the. it's a news service for 99 cents a week with mostly original content with some 100 journalists being hired. rupert murdoch says this is his number one most exciting project. now, the daily may also be available on some other platforms, some other tablet devices like the galaxy which is available from verizon as well as the amazon kindle. but when you start porting a product across multiple devices it can be problematic. >> the "wall street journal" on the web and, you know, if i wanted it on the kindle, it's another fee. if i want it on the ipad it's

plowed out for us. that's yet to be seen. road conditions are bad. i want to show you at a gas station normally something you see in january with all these trucks pulled over a lot of cars and families. they are here to put chains on and i want to give you a quick idea of our little truck this morning. we got through colfax where the road was closed yesterday, open this morning. no word on whether they will close it today. couple miles up we saw fog and black ice. so if you are coming this far, use caution coming through there. right before we got to gold run we started seeing the snow, the rest stop at gold run is closed. there is a little backup there because of the trucks trying to get in. once we passed through gold run, the conditions got really bad. we had to slow down to 20 miles an hour and that's where the chain check is. also this morning, this is the person who is making all the money this morning, you're selling the chains. this isn't normal for this time of the year? >> this is absolutely not normal. we don't usually sell this many chains until the beginning of

winds up to 15 miles an hour. again, more showers expected through the day. this low pressure system is going to be moving closer to the bay area throughout the day and tonight. the closer it gets, the greater the likelihood of picking up some rainfall. so late tonight and also tomorrow, more rainfall expected. the sierra forecast, tony just showed us a wonderful shot of how snowy it is up there. a winter storm warning will be in effect late tonight and also throughout the day tuesday. wednesday plenty of sunshine but temperatures will cool down to two below as we move into the holiday. rainfall on tap for tomorrow. plenty of sunshine wednesday, thursday and friday with highs in the 50s. saturday and sunday, another round of showers likely. that is your weather this morning. for your traffic, here's elizabeth. >> you mentioned the holiday and a lot of people are probably packing up their suitcases right now going to the airport. we sent chopper to 880 near the oakland airport. problem-free by hegenberger,

101 over by sfo, and san bruno looks great and problem-free there, as well. thank you, chopper 5. mass transit if you plan to use bart to head towards the airport, everything is on time. looks good as well for ace, muni and caltrain. to our maps, show you some live traffic conditions at the bay bridge toll plaza. they turned the metering lights on just before 6:20 so we have a good sized backup, unfortunately. it's backed up beyond the 880 overcrossing, at least 15 minutes to get you onto the bridge. otherwise, we haven't seen any other big issues. an earlier high wind advisory for the bay bridge was cancelled early this morning. it's still wet out side. this is a live look in san jose, traffic heading out of down san jose. fortunately we have not seen any huge hot spots despite the slicker roadways. in fact, your drive time holding steady there about 11 minutes between 101 and cupertino. let's go back out to the sierra. there is so much fresh powder out there. and a lot of people putting on chains. you don't want to get caught off guard like that one guy wearing shorts this morning.

eased. there is a chance the full- body scans and the patdowns at the airport could be eased. mark sayre reports from the head of the san jose international airport. >> reporter: yesterday the director of tsa was saying there would be no changes to these policies. but he is singing a different tune this morning particularly

on the morning talk shows. passengers of course have been complaining about these full- body scanners and also the patdowns as recently as yesterday the tsa director saying on the sunday talk shows there would be no changes to the policies but in a written statement yesterday, and again on those tv talk shows this morning, tsa director john pistole now saying that federal officials do understand there needs to be a balance between safety and privacy. it committed to reviewed policies and the patdowns saying they must be quoting now as minimally invasive as possible. the tsa also saying only 1% of passengers are opting out of the full-body scans and then having to go through the patdown procedure and they are also very concerned about this potential protest on wednesday urging people not to go through the full-body scans and gum up the airline security system on a busy day. >> thank you, mark sayre. berkeley police say the sexual assault of a 13-year-old girl was not a random attack.

they say this man, 27-year-old omar sosa, attacked the girl saturday morning after climbing into her unlocked bedroom window. sosa and the family reportedly knew each other. police belief headed to mexico. the political wrangling over who will be the next mayor of san francisco will continue this week. tomorrow, the board of supervisors may pick an interim mayor to replace gavin newsom who is about to become lieutenant governor. but more likely, discussions will concentrate on how candidates are nominated. board members will vote on a process where each supervisor can nominate one candidate. we have rain, snow, we have tracy to tell us what's going on. hey, trace. >> i know. it's like an all-in-one this morning a combo deal. here's a look out our hi-def doppler. we are seeing essentially showers in the bay area in one location in the north bay near the santa rosa area. so we'll move in closer. light showers from bodega bay

gates extend into the macarthur maze. typical monday morning commute for folks heading into san francisco. i do want to let you know if you are planning ongoing to los angeles for the holidays and you're leaving right now we have big problems. both directions of i-5 are shut down coming out of the grapevine in santa clarita. all lanes have been shut down. there is a tanker accident in a happened around 3:00 this morning. they are working to clear it right now but they actually are running a traffic break in the stretch. let's go to our maps. 280 looks okay right now out of downtown san jose. you can see the roads are still a little slick. we haven't seen too many accidents even despite that. so it looks ak now along the peninsula. and westbound 580 tracking the ride out of the altamont pass looks ak right now. a little sluggish and then it slows again from hopyard up towards 680. back to you. >> thank you. if you have a story idea or comment would you would li
